The recent developments surrounding the National Eligibility cum Entrance Test (NEET) and the University Grants Commission National Eligibility Test (UGC-NET) have caused significant public uproar. Allegations of malpractices during the NEET exams and the abrupt cancellation of the UGC-NET for June 2024 have added fuel to the fire. In response to the growing concerns and controversies, the Public Examinations (Prevention of Unfair Means) Act, 2024 was enacted and came into effect on June 22, 2024.

This new legislation is designed to combat and prevent unfair practices in public examinations and common entrance tests across the country. Key provisions of the Act include:

  1. Prevention of Unfair Means: The Act aims to curb any form of cheating, impersonation, and other fraudulent activities that compromise the integrity of public examinations.
  2. Confidentiality of Exam Information: It strictly prohibits the disclosure of any confidential examination-related information before the scheduled time. This measure is intended to maintain the security and fairness of the exams.
  3. Unauthorized Entry: The Act bans the entry of unauthorized individuals into examination centers with the intent to create disruptions or engage in illicit activities.
  4. Penalties for Offenses: Violations of the Act are considered serious offenses, with punishments ranging from three to five years of imprisonment. Additionally, offenders can be fined up to Rs 10 lakh.
  5. Nature of Offenses: Offenses under this new law are classified as cognizable, meaning the police can arrest without a warrant; non-bailable, indicating that bail is not a right but a matter of judicial discretion; and non-compoundable, signifying that the charges cannot be dropped even if the complainant and the accused reach a settlement.

The enactment of the Public Examinations (Prevention of Unfair Means) Act, 2024 represents a significant step towards ensuring the integrity and credibility of the examination process in India. However, its implementation and enforcement will be crucial in determining its effectiveness in addressing the issues of malpractice and restoring public trust in the examination system.
